    Toner copyright patents

    Hello everyone. I can't seem to find info about copyright laws regarding toners. My question is : is it copywright infringement if you use original toner boxes or original toner recipients? Like buying original toners from 3'rd party and selling them as high quality compatibles. Or unboxing them and selling them in another packaging, which not belongs to OEM. In none of the cases above , the toners are sold as compatibles and not as originals. Is it legal? Or buying used original toners, refilling them and selling them. I read an article about lexmark vs some company regarding this issue and it was said that copyright does not extend beyond the buyer. So after you buy the oem cartridge you kinda can do anything with it. It is yours and only yours. Can someone provide insight about this? Thank you

    The whole thing just sounds like simple fraud to me.
    Started in the copier service business in the fall of 1988 and worked at the same company for 33.5 years, becoming the senior tech in 2004 but left to pursue another career on 4/29/22.

    From wich point of view? If you are the customer, you are getting a recycled oem toner, basically at a price of a high quality compatible one.

    In Europe it would not be allowed. This would be identified as a forgery. it's like selling a fake Louis Vuitton bag for $15
    Yes, the quality of the materials may seem the same but in reality it is not.

    Sorry for reviving this old thread, but is it legal to sell xerox metered toners on open market? I see a lot of companies here in Europe who sell metered toners or other supplies. I am just curious how things stand in this matter.

    If it deceives the buyer its fraud.
    Buying toner from contract customers where the toner is included would be theft on the part of the seller that would extend to the buyer if you were not aware of it.
