Biden In 2016: President Has ‘Constitutional Duty’ To Fill Vacant Supreme Court Seat


But then-Vice President Joe Biden said otherwise at the time, declaring that the president had a “constitutional duty” to seat a justice on the high court when a vacancy arises.
“The president has the constitutional duty to nominate; the Senate has the constitutional obligation to provide advice and consent,” Biden wrote in a New York Times op-ed in 2016.
“It is written plainly in the Constitution that both presidents and senators swear an oath to uphold and defend,” he wrote. “That’s why I was so surprised and saddened to see Republican leaders tell President Obama and me that they would not even consider a Supreme Court nominee this year. No meetings. No hearings. No votes. Nothing. It is an unprecedented act of obstruction. And it risks a stain on the legacy of all those complicit in carrying out this plan.”

In a speech at Georgetown University, Biden also said: “I would go forward with a confirmation process as chairman, even a few months before a presidential election, if the nominee were chosen with the advice, and not merely the consent, of the Senate, just as the Constitution requires.”
Biden has made a 180-degree turn with the death of Ginsburg, writing on Twitter on Friday: “Let me be clear: The voters should pick a President, and that President should select a successor to Justice Ginsburg.”
The vice president was echoing the words of his boss, former president Barack Obama. After Scalia’s death, Obama declared that he had a duty to nominate a successor.

“The Constitution vests in the President the power to appoint judges to the Supreme Court. It’s a duty that I take seriously, and one that I will fulfill in the weeks ahead,” Obama wrote in 2016.
Obama said he was looking for a replacement with a “sterling record, deep respect for the judiciary’s role, an understanding of the way the world really works.”
“That’s what I’m considering as I fulfill my constitutional duty to appoint a judge to our highest court. And as Senators prepare to fulfill their constitutional responsibility to consider the person I appoint, I hope they’ll move quickly to debate and then confirm this nominee so that the Court can continue to serve the American people at full strength,” Obama wrote.

But like Biden, Obama has flip-flopped on the issue — now that a Republican president is in office and the GOP controls the Senate.
“Four and a half years ago, when Republicans refused to hold a hearing or an up-or-down vote on Merrick Garland, they invented the principle that the Senate shouldn’t fill an open seat on the Supreme Court before a new president was sworn in,” he wrote in a statement.

A basic principle of the law — and of everyday fairness — is that we apply rules with consistency, and not based on what’s convenient or advantageous in the moment. The rule of law, the legitimacy of our courts, the fundamental workings of our democracy all depend on that basic principle. As votes are already being cast in this election, Republican Senators are now called to apply that standard. The questions before the Court now and in the coming years — with decisions that will determine whether or not our economy is fair, our society is just, women are treated equally, our planet survives, and our democracy endures — are too consequential to future generations for courts to be filled through anything less than an unimpeachable process.

Obama was considered a "Lame Duck" president at that time. IMHO Garland would not have been a good appointment to SCOTUS, due to his biased views on the Constitution. He was one (like many dems) that felt the Constitution was outdated and should be scrapped. That 'paper' was the one of the foundational documents that set forth the rules for the way this country should be run. BUT in today's time with all the moral decay, radical views and total disregard for the " American " way of life. Trump has a Constitutional Duty to fulfill and with the threats coming from NanNan and the House, along with his promise to appoint Constitutional Judges, it is his sworn duty to fulfill those duties.


Just say NO to the flip flop democrats. They can't have their cake and eat it too.

Solid Majority Of Americans, Including Democrats, Want Supreme Court Hearings During Election Year, Poll Finds

A solid majority of Americans across the political spectrum support holding hearings for Supreme Court nominees during a presidential year, according to a poll conducted just a few days ago.
A new Marquette Law School national survey found that solid majorities of Republicans, Democrats, and Independents indicated that if a seat was vacated during an election year that hearings should take place.

“In this poll, conducted in the days before Ginsburg’s death, a substantial majority of respondents of both parties say that if a vacancy occurred during the 2020 election year, the Senate should hold hearings on a nominee, with 67 percent saying hearings should be held and 32 percent saying they should not be held,” Marquette Law School said. “Views on holding hearings do not vary much by partisanship.”
The poll found that 68 percent of Republicans, 71 percent of Independents, and 63 percent of Democrats indicated that there should be hearings held if a seat became vacated during a presidential election year.
This is bad news for Democrats as they desperately try to stop President Donald Trump and Senate Majority Leader Mitch McConnell (R-KY) from filling the seat vacated by Supreme Court Justice Ruth Bader Ginsburg, who died last week at 87 years old. Democrats and leftists in the media have responded to the vacancy by threatening acts of violence and even threatening to undermine the legitimacy of the nation’s highest court by packing the court with judges that suit their ideology.

Ginsburg allegedly told her granddaughter that her dying wish was that she would “not be replaced until a new president is installed.”
However, Ginsburg said in 2016 — when Democrats were trying to fill a seat during an election year — that only having eight justices on the court was “not a good number.”

“That means no opinions and no precedential value; an equal division is essentially the same as a denial of review,” Ginsburg said on the issue of the Supreme Court only having eight justices. “Eight, as you know, is not a good number for a multi-member court.”

Trump gave a classy statement upon learning about Ginsburg’s passing as he spoke to a group of reporters with Elton John’s “Tiny Dancer” playing in the background.
“She just died? Wow,” Trump said. “I didn’t know that. You’re telling me now for the first time. She led an amazing life. What else can you say?”
“She was an amazing woman. Whether you agreed or not, she was an amazing woman who led an amazing life,” Trump continued. “I’m saddened to hear that.”
“Trump’s comments come after Democrat Senate Minority Leader Charles Schumer (D-NY) completely skipped over honoring Ginsburg in his initial statement following her death, and instead jumped straight into politics,” The Daily Wire reported. “In his first tweet on Ginsburg’s passing, Schumer wrote: ‘The American people should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new president.'”

Mind you ALL the top dems said in 2016 that there SHOULD be a SCOTUS appointment. Here again we have them Flip Flopping on their views just to fit their agenda. NanNan says she would consider a NEW impeachment over this issue.

Back in the days of the Vietnam-era, men of a certain age were expected to join the military. You either joined the military or you received a deferment to put it off for a year. The media loves to talk about how Trump dodged being drafted in the war because of bone spurs.
The media has even given him the nickname of Captain Bone Spurs because they have questioned whether he even has bone spurs. Democratic Senators have even demanded that Trump get X-rays to prove that he has the bone spurs that were claimed to get his fifth deferment.
For years, the media has tormented Trump about his deferments. After all, he had five. Here’s something that the media has probably known about but won’t speak of: Biden also had five deferments.
Wait, what? How come the media isn’t talking about Biden’s deferments? How dare someone who has worked in Congress for decades, served as a VP, and is running for president skip out on his military duty!
The reason that the media isn’t sharing anything about Biden’s deferments is that it would make him look bad. Or, rather, worse than he already looks. That, and they’d have to apologize for Trump.
Lots of people got deferments. With Trump and Biden being so close in age, it’s not surprising that they were both dealing with deferments when trying to be drafted into the Vietnam War.
So, Trump had a total of five deferments: four that were education-related and one that was for bone spurs. It was diagnosed by a doctor. And with bone spurs, it’s not possible to stand for extended periods of time. It meant no military time.
Now, Biden has a similar story. He had four deferments for education while he was attending the University of Delaware as an undergraduate and later when he was a law student at Syracuse University.
The fifth one is the one that is really the head scratcher. Biden received the fifth deferment as a result of asthma. Wait, the Senator turned VP has asthma? Well, this doesn’t sound right. Clearly, this must be incorrect.
Nope, his fifth and final deferment was for asthma. He was given a Selective Service Classification of 1-Y, which meant that he would only be available to the service if there was a national emergency.
The strangest thing about the asthma diagnosis is that he has never mentioned that he has asthma. Even in his memoir, he talks about being very active – but no mention of asthma. For most people with asthma, it prevents them from being active.
Biden talked heavily within his memoir about being a lifeguard and playing football. This wouldn’t be possible if he suffered from asthma-like he claimed to the military.
So, the media has no problem constantly be reading Trump because he got out of serving in the military because of bone spurs, but they aren’t even mentioning that Biden has the same number of deferments. While Trump very well may have bone spurs, it is highly questionable whether Biden has asthma. It seems that with Biden being in the public eye for as many years as he has been, that should have been a topic once or twice.
No one is talking about Joe Biden’s deferments because it would make him look weak. The liberal media doesn’t want to discuss that Biden may have lied and cheated his way out of having to serve in Vietnam just like they claim Trump has done.
