It might get treated the same way the previous Democrat administration handled the missing emails and illegal server investigation in 2016. The evidence was there. The excuse used to explain not prosecuting was bogus, the regulations violated did not require specific intent. The reason she wasn't prosecuted then is because there wasn't a single Federal prosecutor willing to risk his/her job.
Durham on the other hand doesn't give a damn. Biden is going to have to pardon the Hildabeast.

Special counsel John Durham is using court filings to spread conspiracy theories about the 2016 election, attorneys for defendant Michael Sussmann said in a late Monday court filing.
filing, Durham said that a tech executive linked to Sussmann had “exploited” access to White House servers by “mining” them for data in a bid to gather “derogatory information about Donald Trump.
Conservative media and the Trump family seized upon the allegation to dust off a familiar refrain: that the Obama administration and/or the Hillary Clinton 2016 presidential campaign had “spied” on Trump during or after the election.
This led to an outpouring of rage on the right, which cast the filing as proof that Trump was right about the spying allegations all along.
... Republican interests are seizing onto the report as gospel partially in an attempt to distract from the damming findings that the Jan 6th Committee is sure to soon reveal to the American people.
