                    McConnell says he will oppose Jackson's nomination to the Supreme Court

                    McConnell said he made the decision after watching Jackson's 'performance this week'


                    Senate Minority Leader Mitch McConnell, R-Ky., announced Thursday that he will oppose President Biden's first U.S. Supreme Court nominee Judge Ketanji Brown Jackson, even after going into the confirmation process with an "open mind."

                    "After studying the nominee’s record and watching her performance this week, I cannot and will not support Judge Jackson for a lifetime appointment to the Supreme Court," McConnell said from the Senate floor.

                    McConnell's remarks on Jackson's nomination and his opposition to her appointment follow a series of "soft on crime" questions she faced from Republican members of the Senate Judiciary Committee.
                    Several Republicans on the Judiciary Committee repeatedly pressed Jackson with questions about her sentencing of child porn offenders as a federal court judge and implied she was too lenient on criminals when her sentences were less than what prosecutors and sentencing guidelines recommended.

                    "All I can say is that your view of how to deter child pornography is not my view," Sen. Lindsey Graham, R-S.C. told Jackson during one exchange. "I think you're doing it wrong. And every judge who does what you're doing is making it easier for the children to be exploited."

                    On Tuesday, Republican Missouri Sen. Josh Hawley also sparred with Jackson as he continued his public questioning of Jackson’s record as it relates to sentencing decisions for child pornography convictions.

                    At one point in the hearing, Hawley brought up a case where an 18-year-old was sentenced to three months in prison for possessing a large quantity of child pornography and read Jackson’s comments from the sentencing where she expressed sympathy for the defendant and his family.

                    "This is something I really need your help understanding," Hawley said as he read Jackson’s words consoling the family of the defendant and saying she feels "sorry for the anguish this has caused" them. Jackson also said that she believes sex offenders are "truly shunned" in our society.

                    "I'm just trying to figure out, Judge, is he the victim here, or are the victims the victims?" Hawley asked.

                    Sen. Ted Cruz, R-Texas, displayed a poster of eight child porn cases where he said Jackson sentenced the defendants to less time than what the government prosecutors and sentencing guidelines recommended. He asked why she consistently gave out lesser sentences on child porn cases "100% of the time."

                    "Senator, no one case can stand in for a judge's entire sentencing record," Jackson said. "I've sentenced more than 100 people. You have eight or nine cases in that chart."

                    Cruz continued to press for answers on her sentencing decisions, which prompted Durbin to intervene. Cruz lashed out and accused Durbin of filibustering on behalf of Jackson.

                    That prompted a lengthy and heated exchange between Cruz and Durbin which delayed the hearing.
                    "I have never seen the chairman refuse to allow a witness to answer a question," Cruz told Durbin as the chairman pounded the gavel. "You can bang it as loud as you want."

                    "At some point you have to follow the rules," Durbin shot back in trying to restore order.
                    Some Democrats, meanwhile, pushed back on Republicans "soft on crime" case. Judiciary Committee Chairman Dick Durbin, D-Ill., said Republicans simply want to "showcase talking points for the November election."

                    "You've made a mess of their stereotype," Durbin told Jackson. "The endorsement of the Fraternal Order Police, the International Association of Chiefs of Police just doesn't fit with their stereotype of a Harvard grad Black woman who is aspiring to the highest court in the land."

                    Others, including Sen. Cory Booker, D-N.J., touted Jackson's endorsement from the Fraternal Order of Police.

                    "You were endorsed by the largest organization of rank and file police officers," Booker said.

                    ... no surprise to anyone that the Turtle will try to block this key nominee for President Biden. KBJ is super qualified and would be historic if confirmed. Some Senate Republicans may break from McConnell on this confirmation vote.

                    ...the Senate Democrats with 51 votes can pass this without a 60 vote threshold.

                    If confirmed, the 51-year-old federal judge will become the first Black woman to sit on the Supreme Court, where members are appointed for life. She currently serves on the U.S. Court of Appeals for the District of Columbia Circuit, a job the Senate confirmed her to last year.

                    Jackson, President Joe Biden’s first high-court nominee, can win confirmation with the support of merely 50 senators in the evenly split chamber, where Vice President Kamala Harris holds the tie-breaking vote. No Democrats so far have indicated they will vote against Jackson.

                    Jackson’s Democratic supporters, as well as some Republican lawmakers, suggested during the hearings that her performance before the Senate has not diminished her chances of confirmation.

                              US Senator Joe Manchin says he will vote for Supreme Court nominee Ketanji Brown Jackson


                              West Virginia Democratic Sen. Joe Manchin announced on Friday that he plans to vote for President Joe Biden’s Supreme Court nominee Ketanji Brown Jackson, a move that all but guarantees she will be confirmed.

                              In a statement outlining his decision, Manchin said, “I met with Judge Jackson and evaluated her qualifications to be a Supreme Court Justice. After meeting with her, considering her record, and closely monitoring her testimony and questioning before the Senate Judiciary Committee this week, I have determined I intend to vote for her nomination to serve on the Supreme Court.”

                              Manchin’s announcement is notable since he is a closely-watched moderate Democrat and key swing vote in the Senate. His decision to vote “yes” helps solidify the vote math for Senate Democrats to confirm the nominee.

                              Senate Democrats are hoping to move swiftly to a confirmation vote by the full Senate by early next month. They can confirm Jackson to the Supreme Court without Republican support if every member of their caucus votes in favor, which appears on track to happen, and Vice President Kamala Harris breaks a tie. It is not yet clear if Jackson will win any Republican votes.

                              Senate Majority Leader Chuck Schumer vowed in a floor speech Thursday to bring the nomination to the Senate floor “in short order” once the Senate Judiciary Committee advances the nomination. The Judiciary Committee is expected to vote on the nomination on April 4.

                              Jackson appeared before the committee for high-profile confirmation hearings this week, which featured intense questioning by Senate Republicans.

                              So far, no Democrats have publicly signaled they would vote against the nominee, even as Republicans have worked to unleash potentially politically damaging attacks such as accusations that Jackson is soft on crime, a charge the nominee and many Democrats have pushed back on.

                              While Republicans have attacked the nominee’s record this week, Democrats have praised her credentials and experience, describing her as exceptionally qualified. Democrats have also consistently emphasized the historic nature of Jackson’s nomination. If confirmed, Jackson would be the first Black woman to serve as a Supreme Court justice.

                              When the Senate voted to confirm Jackson last year to fill a vacancy on a powerful DC-based appellate court, three Republican senators voted with Democrats in favor: Sens. Lindsey Graham of South Carolina, Susan Collins of Maine and Lisa Murkowski of Alaska. As a result, those three Republicans have been closely watched this week.

                              Collins and Murkowski are not on the Senate Judiciary Committee, so they did not have a chance to question the nominee during the hearings.

                              But Graham is a member of the panel. The South Carolina Republican directed fierce, and highly critical, lines of questioning toward the nominee as he appears to be signaling he will not support her nomination.
