The US constitution makes it very clear that Congress have the power to implement tariffs, not the President.
However, Trump has been using power granted to the President by Congress in 1977, specifically for the purpose of responding to an international emergency.
It was called the International Emergency Economic Powers Act, and has been primarily used by US Presidents to impose sanctions on adversaries during moments of crisis, and as a tool to impose American foreign policy interests.
The U.S. Court of International Trade just ruled that Trump's "Liberation Day" tariffs exceeded his authority under this act, and were therefore illegal.
The court ruled that Trump's declaration of a national economic emergency based on long-standing trade deficits and foreign manufacturing reliance did not meet the statutory threshold of an "unusual and extraordinary threat" required under the IEEPA.
If Trump was smart... he'd use this as an off-ramp and blame the courts for his failure. But I expect he'll take this one to the Supreme Court.
