i Know its the hard drive is there a way to to reformat to get the machine to at least pass a copy. any help appreciated. did try the hd check

If doing a hard drive check in service mode fails and pressing and holding 1 and 9 on machine startup (press power button on right hand side) until rectangles start to shown on the screen fails to bring up the download mode screen after an hour or two then you'll just have to replace the hdd.
I assume that you've tried turning the machine off and on again and checked the connection between the main controller and the hdd and tried to get into download mode.
The hard drive will need to be replaced anyway so may as well do it.
