Why is it you are asking for DBS checks in the first place for a mobile engineer? There is no legal reason for them.

I have not said there is a legal requirement.
We require it as part of our terms of employment, as a lot of our customers are schools.
If we suddenly employed someone who was on a register for kiddy fiddling, it would not be wise for us to send them into a school.
Its a requirement policy by our company, if someone does not want to be checked then they dont need to apply

in a single month) andnot be considered to be regulated activity and therefore there would be no eligibility.

I do understand the dilema in regard to 'kiddie fiddling' but as the law stands unless the following criteria is met then it is an offence for a person to require/demand/advertise.
I have been through this with a previous company (i hated working there and left a drunk & disorderly(D&D) on my DBS so they would not take me on after probation - appealed and had removed the D&D the week after i left as it shouldn't have been there) DBS in Liverpool agreed with me that the actions of the company were illegal and warranted prosecution.

It is only legal to ask for one if within the contract (i.e with foresight) it stipulates that the same engineer will be on site on the same day every week. It cannot just be because you might be there. It also excludes all machines that are not in an area to which children have access so staff room, teacher only rooms, secretary offices are all excluded.
It's just how the law works - (I have done some work with DBS regarding this and a company that was using them incorrectly. That is that they used them and the excuse of 'our engineers work in scools' to bypass the rehabilitation of offenders act, which is also unlawful.
