    Trump's lawsuit over Twitter ban dismissed by federal judge

    US District Court Judge James Donato granted Twitter's motion to dismiss the lawsuit

    A federal judge in San Francisco has dismissed a lawsuit from former President Trump against Twitter, challenging the social media company for banning himself and others from the platform.

    The lawsuit alleged that Twitter violated the First Amendment of the United States Constitution, claimed that Section 230 of the Communications Decency Act is unconstitutional, and also alleged that Twitter used "deceptive and misleading practices" that are in violation of the Florida Deceptive and Unfair Trade Practices Act.

    Donato wrote in his order that the First Amendment doesn't apply to private companies, adding that Trump is "not starting from a position of strength."

    Twitter banned Trump in January 2021 and alleged that he contributed to the violence that took place at the Capitol on Jan. 6.

        In his new memoir, “A Sacred Oath,” Esper writes that he had to press President Trump to send aid to Ukraine, and also walked the president back from ideas such as shooting protesters and missile strikes in Mexico.

                      FBI executes search warrant at Trump's Mar-a-Lago in document investigation


                      The FBI executed a search warrant Monday at Donald Trump's Mar-a-Lago resort in Palm Beach, Florida, as part of an investigation into the handling of presidential documents, including classified documents, that may have been brought there.

                      The former President confirmed that FBI agents were at Mar-a-Lago and said "they even broke into my safe." He was at Trump Tower in New York when the search warrant was executed in Florida.

                      "My beautiful home, Mar-A-Lago in Palm Beach, Florida, is currently under siege, raided, and occupied by a large group of FBI agents," Trump said in a statement Monday evening.

                      The extraordinary move to search the home of a former president raises the stakes for the Justice Department and comes as Trump's legal problems continue on multiple fronts. Trump is also expected in the coming months to announce he will launch another bid for the White House in 2024.

                      The Justice Department has two known active investigations connected to the former President, one on the effort to overturn the 2020 presidential election and January 6, 2021, and the other involving the handling of classified documents.

                      The search began early Monday morning and law enforcement personnel appeared to be focused on the area of the club where Trump's offices and personal quarters are, according to a person familiar with the matter.

                      The FBI's search included examining where documents were kept, according to another person familiar with the investigation, and boxes of items were taken. Following the National Archives' recovering of White House records from Mar-a-Lago in recent months, the FBI on Monday had to verify that nothing was left behind.

                      Christina Bobb, Trump's attorney, said the FBI seized documents. "President Trump and his legal team have been cooperative with FBI and DOJ officials every step of the way. The FBI did conduct an unannounced raid and seized paper," Bobb said

                      Plans for the search at Mar-a-Lago would have been reviewed by the top levels of the FBI and Justice Department.

                      A White House official said it was not notified about the search.

                      Investigation into documents

                      The National Archives, charged with collecting and sorting presidential material, has previously said at least 15 boxes of White House records were recovered from Trump's Mar-a-Lago resort -- including some that were classified.

                      Investigators visited Mar-a-Lago in recent months to speak with Trump's attorneys about material taken from his time in the White House. Trump was present at Mar-a-Lago when the visit occurred, according to the sources.

                      Trump's attorneys showed investigators documents at the time, though it is unclear which ones and how many, one of the sources said.

                      In April and May, aides to Trump at Mar-a-Lago were interviewed by the FBI as part of the probe into the handling of presidential records, according to a source familiar with the matter.

                      The FBI on Monday had to verify that nothing was left behind, according to the person familiar with the investigation.
                      "It is a federal crime to remove classified documents wrongly. And so if you are filling out that affidavit and you have to list the crime, you can list that as the crime,"

                      The timing of the search held with the longstanding department rule not to execute politically sensitive moves within 90 days of an election.

                      "Today is just about 90 days out exactly from the midterms, I think maybe 91 or 92 days out. That policy, that may be a reason why they did it today because they want to stay clear of that if they're interpreting that as a 90 day rule," he said.

                            Clinton-linked lawyer says Trump could be barred from re-election after FBI raid, cites US Code

                            The FBI executed a search warrant of Trump's Mar-a-Lago property reportedly seeking classified documents he allegedly took from the White House


                            Marc Elias, a top lawyer for Hillary Clinton's 2016 presidential campaign, said Monday that former President Trump could be disqualified from making another run at the White House in 2024 following the FBI raid of his Florida residence.

                            FBI agents executed a search warrant of Trump's Mar-a-Lago property on Monday reportedly seeking classified documents he allegedly took from the White House when he left office in 2021.

                            The search warrant was conducted in connection with the National Archives, according to a senior government official.

                            This led Elias to cite U.S. Code Title 18, Section 2071 to highlight that Trump could be barred from seeking public office again, as the former president continues to drop hints that he will soon announce plans to seek a second term as commander-in-chief.

                            "The media is missing the really, really big reason why the raid today is a potential blockbuster in American politics," Elias wrote in a tweet.

                            Elias pointed to the passage of U.S. Code Title 18, Section 2071 that states, "Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States."

                            However, legal challenges could make efforts to prevent Trump from running again under this code difficult, Elias noted in a follow-up tweet.

                            "Yes, I recognize the legal challenge that application of this law to a president would garner (since qualifications are set in Constitution). But the idea that a candidate would have to litigate this is during a campaign is in my view a "blockbuster in American politics," he wrote.

                            The Presidential Records Act of 1978 requires presidential administrations to preserve certain documents.

                            According to the National Archives, the presidential records in 15 boxes taken from Mar-a-Lago earlier this year include documents classified over national security concerns.

                            The agency has also called on the Department of Justice to probe whether the former president violated federal law in his handling of records.

                            "Because [the National Archives and Records Administration] identified classified information in the boxes, NARA staff has been in communication with the Department of Justice," then-U.S. archivist David Ferriero wrote in a letter to Congress.

                            Trump released a statement Monday announcing the FBI's raid and he slammed the federal government for its search of his property.

                            ... as US Attorney General Merrick Garland has said multiple times "no one in the USA is above the law" and that includes ex Presidents.
