Often restaurants are short staffed and ask their low paid employees to work overtime. This ovetrime pay is an important supplement to their regular pay. You cannot force an employee to work overtime.
Dishes will not get cleaned properly. Tables will not get cleared promptly. Tables will not get waited on quickly. Employers will quickly get the message and ignore Trump's proposed new laws.
I would rather get paid 1.5 times on overtime rather than no taxes on tips.
