And the party in control of the Senate, currently the Democrats, can change the Senate rules, including when the filibuster can be used, when ever they wish to. The filibuster is not in the US Constitution.
In 2020 @POTUS @JoeBiden denounced the rampant abuse of the filibuster last year {2020} @johnrtobertsFox and his stall did some digging and found that the Republicans used it once. Democrats used it 327 times.

Of the 5 longest filibusters in history, 3 of them were Democrats, longest, 3rd longest and 5th longest. Of those, the longest was against the 1957 Civil Rights act.
Very seldom is a true filibuster actually used because neither party wants to hold up discussion of other legislation. Instead a cloture vote is used. It also requires 60 votes to pass. If cloture is approved then a final vote is scheduled and not further debate on the issue will be available. If it is not passed then it is the up to the Vice President as the head of the Senate to decide whether to continue debate or table the issue and move on to some other issue.Comment
