Well, since he was the PRESIDENT, not he vice president, he had the authority to declassify anything he wanted to. Biden did not have that authority. Since our justice system is based on the concept of innocent until proven guilty, the presumption should be that Trump did declassify those found at his residence until it can be proven otherwise. Biden should not have had those documents once he was out of office unless his (then and current) boss declassified them. Has anyone spoken to Obama about this? Didn't think so. There are certain laws that the violation of which is mere possession, classified documents may fall under that umbrella but I'm not sure 100%, it is usually treated as such (except if the violator is a high ranking Dem, like Biden or Clinton).
