According to the result of the court case that came out today, the answer is "NO". At least that's what I heard. And so it continues to go through the courts. None of these "magic bullets" that legislators enact for public health reasons ever have the intended effect and believe me we've had a ton of them over here in the U.K.
The fact remains that no food outlet anywhere in the world forces anyone to eat or drink anything. Every adult person is in control of what they shove into their pie holes and the choices you make determine the size you become.
Any argument made about portion sizes being too big, fast food being too ubiquitous and convenient is just excuses, people trying to shift the blame for their own poor choices onto someone else. If you really wanted healthy food in a sensible portion size you'd have had a tofu sandwich for lunch rather than an enormous burrito ... Hey I'm not judging anyone, I'm as guilty as the next guy of opting for a McLunch on more occasions than is healthy..... but that is also why I take 40" waist pants.
I made the conscious decision to eat less fast food and take a packed lunch to work. The result, I've lost 14lbs since Xmas. All that without local or national government agencies legislating about anything.Comment

The judge struck down the ban because it was "arbitrary and capricious".
The Burger King could not serve 17oz sugary drinks, but could serve larger diet soda or un-sweet tea, making it difficult to regulate. In addition, because of the way the law was written, the gas station down the street could sell any size of anything they wanted.
...not to mention that the whole thing was stupid to begin with. Fast food chains generally offer free refills, so it only creates an inconvenience having to refill your cup more often. Maybe they should take a look at the menu - Big coke 300cal... Double Whopper with Cheese and Large Fries 1500cal... Hmmm, which one is going to put more strain on the seams of your pants.
The judge did not delve into if the government has any business telling us how to run our lives - and the answer is NO! It's not the government's job to run our lives - they can't even run their own business without bankrupting everything they touch.
No wonder they desperately want to take away our guns if they want to crawl up our ass with a microscope and try to micromanage people like that. I get enough of that crap at work.73 DE W5SSJComment

If they teach proper health in school, it wouldn't be an issue. I believe choices about your own body and health are personal and government should not be a hypocrite about it. Alcohol and tobacco kill more every year than all drugs combined in the past 40 years. To me, if they want to control anything it should be the salt/sugar quantities per gram/pound/whatever instead of absolute quantity. Everyone has the right to put what food they want into their bodies but I think the City has the right to encourage people to make better choices when it's citizens are faced with an obesity epidemic.
The main oponents to this law are those who profit from the increased consumption of soft drinks.
According to Harvard University’s School of Public Health. “Strong evidence indicates that our rising thirst for ‘liquid candy’ has been a major contributor to the obesity and diabetes epidemics,” the public-health school reported on its website.Comment
